Under an Order of Judicial Sale entered in United States vs. defendants, Civil Action No. 06-00266 SPK LEK, United States District Court for the District of Hawaii, the United States will offer to sell at public auction to the highest bidder, according to law and pursuant to the terms and conditions set herein, the property described below.

Legal Description: All of that certain parcel of land situate at Moanalua, Honolulu, State of Hawaii, described as follows:
Lot No. 196, area 6,000 square feet, more or less, as shown on Map 152, filed in the office of the Assistant Registrar of the Land Court of the Territory of Hawaii with Land Court Application No. 1074 of the Trustees under the Will and of the Estate of Samuel M. Damon, deceased, and being a portion of the land described in Transfer Certificate of Title Number 70155, issued to Clarence Thing Chock Ching, husband of Dorothy Tom Ching, Thomas Awai, widower, and Fong Ting Mau, husband of Rose Yet Kui Mau, General Partners of International Development Company, as Grantors.
EXCEPTING AND RESRVING THEREFROM unto the Trustees under the Will and of the Estate of Samuel M. Damon, deceased, all artesian and other underground water and rights thereto appurtenant to said premises. TOGETHER WITH a right of way for roadway purposes in common with all others entitled thereto over Lot Nos. 333 and 334, roadways, as shown on said Map 152, which right of way and all appurtenant rights therein shall terminate when said Lot Nos. 333 and 334 are conveyed or dedicated to and accepted by the Territory of Hawaii or other governmental authority for use as public roadways, reserving, however, unto the Grantors the right to convey said Lot Nos. 333 and 334 to the Territory of Hawaii or other governmental authority for use as public roadways. BEING ALSO the same premises referred to in Transfer Certificate of Title No. 72531.

The Terms of Payment: No bid shall be accepted by the IRS unless it is accompanied by a certified check or cashier’s check in the minimum amount of $20,000 made payable to the United States District Court for the District of Hawaii. Before being permitted to bid at the sale, all bidders shall display to the IRS proof that they are able to comply with this requirement. No bids will be received from any person who has not presented proof that if he or she is the successful bidder, he or she can make the deposit required by the Order.
The successful bidder shall tender the balance of the purchase price in certified funds made payable to the United States District Court for the District of Hawaii to the Internal Revenue Service at the address below within thirty (30) days from the date the bid is accepted. In the event the successful bidder defaults on any of the terms contained in the Order, the deposit shall be forfeited and retained by the IRS as part of the proceeds of sale, and the real property shall again be offered for sale, without further permission of the Court, under the terms and conditions of the Order.
The sale of the real property shall be subject to confirmation by the Court. Upon confirmation of the sale and receipt of the entire purchase price, the Court shall issue and the IRS shall deliver to the purchaser, a deed conveying the real property to the purchaser. Upon confirmation of the sale, all interests in, liens against, or claims to, the real property that are or may be asserted by any of the parties to this action are discharged and extinguished. The United States reserves the right to reject any and all bids and to withdraw the property form sale.
 
Form of Payment: All payments must be by certified or cashier’s check. Make checks payable to the United States District Court for the District of Hawaii.
