Under an Amended Order of Foreclosure and Sale Entered in United States of America v. Taxpayer, signed on April 2nd, 2009 and further described as Case No.6:06-cv-1658-Orl-18KRS, the United States will offer to sell at public auction property located in Lake County, FL.

Title Offered: The IRS Property Appraisal and Liquidation Specialist is authorized and directed under 28 U.S.C. 2001 and 2002 to offer for public sale and to sell the subject property to the highest and best bidder for cash, subject to certain other rights as set for the above captioned order. The subject property shall be sold free and clear of all liens and claims of any party to this proceeding.

TERMS AND CONDITIONS OF SALE:

The successful bidder shall be required to deposit with the IRS Property Appraisal and Liquidation Specialist a minimum of twenty percent (20%) by certified or cashier’s check or cash payable to the Clerk of the United States District Court for the Middle District of Florida, immediately upon the being struck off and awarded to the highest bidder. Before being permitted to bid at the sale, bidders shall display to the IRS proof that they are able to comply with this requirement. No bids will be received from any person(s) who have not presented proof that, if they are the successful bidder(s), they can make the payment required by the order of sale.

The balance of the sale price shall be tendered to the IRS Property Appraisal and Liquidation Specialist by certified funds, payable to the Clerk of the United States District Court for the Middle District of Florida, no later than 30 days following the date of sale.

If the bidder fails to fulfill this requirement, the deposit shall be forfeited and applied to cover the expenses of the sale, with any amount remaining to be applied to the outstanding tax liability and the subject property will be re-offered for sale under the terms and conditions of the order.

The sale of the subject property shall not be final until confirmed by the Federal District Court. Upon confirmation of the sale, the interests of, liens against, or claims to the subject property held or asserted by the United States and any other parties to this action shall be discharged and extinguished and the IRS shall execute and deliver a deed conveying the subject property to the purchaser(s) thereof. Redemption rights under state law shall not apply to this sale under federal law.

The successful bidder at the sale shall pay, in addition to the amount of the bid, any outstanding property taxes, estimated at $1189.72, as well as, any documentary stamps and Clerk’s registry fees as provided by law.

The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.

This is not an advertisement of a sale of seized property. This is an information notice only regarding a sale being conducted by the Internal Revenue Service as a result of the foreclosure of an Internal Revenue Service Federal Tax Lien by the Department of Justice.

The Government reserves the right to reject any and all bids or to withdraw the property from sale.
