The Terms of Payment: Terms and Conditions of Sale: The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, a minimum of ten percent (10%) of the bid, with the deposit to be made by certified check or cashier’s check, payable to the United States District Court for the Western District of Texas, immediately upon the real property being struck off and awarded to the highest and best bidder. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service (IRS) proof that they are able to comply with this requirement. No bids will be received from anyone who has not presented that proof. The balance of the purchase price for the property shall be paid to the IRS, Property Appraisal and Liquidation Specialist, within thirty (30) days after the bid is accepted, by a certified or cashier’s check made payable to the United States District Court for the Western District of Texas. If the bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the federal tax liabilities of taxpayer(s)at issue herein. The realty shall be again offered for sale under the terms and conditions of the order of sale.
The sale of the property will confirm itself within 15 days after balance of the sale proceeds are received, unless someone objects to the sale. Upon confirmation of the sale, the IRS shall execute and deliver a quit claim deed conveying the property to the purchaser. On confirmation of the sale, all interests in, liens against, or claims to the Property that are held or asserted by all parties to this action are discharged and extinguished. The IRS shall make return of the Confirmation of Sale for the property, with its proceedings endorsed thereon, showing the manner in which it has executed the same, within 30 days from the date of the sale of the property. The property will be sold without appraisal, subject to any unpaid real property taxes or special assessments, to satisfy the Order of Sale. The government reserves the right to reject any and all bids and to withdraw the property from sale. The sale shall be subject to building fines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any.
The property is offered for sale “where is”, and “as is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.
 
Form of Payment: All payments must be by cash, certified check, cashier´s or treasurer´s check or by a United States postal, bank, express, or telegraph money order. Make check or money order payable to the United States Treasury.
