The property will be offered for sale at public auction and sold to the highest bidder, under the terms and conditions of sale that are set forth below, foreclosing all of the right, title and interest of the defendants.
The successful bidder shall be required to deposit at the time of the sale with the Internal Revenue Service, a minimum of ten percent (10%) of the bid, with the deposit to be made by certified check or cashier’s check, payable to United States District Court, immediately upon the real property being struck and awarded to the highest and best bidder. Before being permitted to bid at the sale, bidders shall display to the Internal Revenue Service proof that they are able to comply with this requirement. No bids will be received from any one who has not presented that proof. (bidder must have cashiers checks in possession for 10% above starting minimum bid up to bidder maximum bid amount). *NOTE* No time will be given for winning bidder to secure funds from a bank if winning bidder bids over 10% of maximum bid funds in hand when the property is declared sold. The balance of the purchase price for the property shall be be sent to the Property Appraisal and Liquidation Specialist Steven Massel (address below), within fifteen days (15) days (March 11, 2009) after the date the bid is accepted, by a certified or cashier’s check, made payable to the United States District Court. If the successful bidder fails to fulfill this requirement, the deposit shall be forfeited and shall be applied to cover the expenses of the sale, with any amount remaining to be applied to the federal tax liabilities of the defendants. The real property shall be again offered for sale under the terms and conditions of the order of sale. The sale of the property will confirm itself within 15 days unless someone objects to the sale. Upon the confirmation of the sale, the Internal Revenue Service shall execute and deliver a quit claim deed conveying the property to the purchaser. On confirmation of the sale, all rights, interests in, liens against, or claims to the property that are held or asserted by all parties to this action, are discharged and extinguished. The property will be sold without appraisal, subject to any unpaid real property taxes or other priority interests to satisfy the Order of Foreclosure and Sale. The government reserves the right to reject any bids and to withdraw the property from sale. The sale shall be subject to building lines if established, all laws, ordinances, and governmental regulation (including building and zoning ordinances), affecting the premises, and easements and restrictions of record, if any. The property is offered for sale “where is” and “as is” and without recourse against the United States. The United States makes no guaranty or warranty of condition of the property, or its fitness for any purpose. The United States will not consider any claim for allowance or adjustment or for the rescission of the sale based on failure of the property to comply with any expressed or implied representation.
